Canterbury PC Brett Wright from Dover cleared of lying about CCTV of arrest of Murston shoplifter Jack Harbour at Debenhams

One of three police officers accused of lying about the existence of CCTV footage of an arrest will not stand trial after a judge dismissed the charge against him today.
PC Brett Wright, 40, was cleared of conspiracy to pervert the course of justice.
But the case will proceed against PC Geoffrey Keen, 31, and 37-year-old PC Daniel Short.
The officers are seen restraining Jack Harbour in the leaked CCTV footage
Canterbury-based Wright, of Manley Close, Dover; Short, of Freshwater Close, Herne Bay; and Keen, of Byllan Road, Dover, had all applied in July to have the charge dismissed.
It relates to the arrest of shoplifter Jack Harbour, who was detained in a holding room at Debenhams in Canterbury High Street on July 11 last year.
A CCTV camera recorded the arrest and the footage, which was leaked online three months later.
The officers were alleged between July 10 and October 31 to have failed to "retain and reveal" that CCTV was available from the holding room.
The charge adds "statements were then completed which led to a person being exposed to a risk of prosecution with intent to pervert the course of justice".
Harbour, 23, from Murston, Sittingbourne, was later convicted of theft - but a charge of assaulting PC Wright by spitting at him was dropped.
The three officers were suspended from duties in October.
Judge Jeremy Carey ruled at Maidstone Crown Court there was insufficient evidence against PC Wright to support the charge

Sophie Khan, a legal director of Police Action Centre, a charity that advises people on their rights if they wish to pursue an action against the police, said she was especially concerned about the powers being used against children.
The solicitor-advocate, specialising in actions against the police, said: “The police need to look at this issue very carefully.
“There needs to be some linked-in thinking about whether it’s necessary to be strip searching children. There must be another reasonable method to try to restrain or detain them without having to go as far as strip searching them.
“The number of people being released without charge seem to show it’s being used too freely.”

Quoted in The Guardian:-

Sophie Khan, legal director of Police Action Centre, a charity that advises people on their rights if they wish to pursue an action against the police, questioned whether strip searches of children were necessary.
"It is disturbing that the Met strip search children as young as 10 years old on a routine basis. Strip searching is an inhuman and degrading experience and children should not be subjected to such treatment unless there is no other feasible method to detect crime available to the police," she said.

Quoted in International Business Times:-

Sophie Khan, legal director at the Police Action Centre pressure group, told IBTimes UK: "The reforms that need to be considered are about hard stops and the information the police have on the person who they want to stop because when things go wrong, they go badly wrong.
"The Mark Duggan case returned a verdict of lawful killing, but this could be different in another case. But there are other priorities such as the use of Tasers and stop and search. There are concerns about training here."

Duggan Was Lawfully Killed By Police, Jury Finds

Wednesday 8th January 2014
The jury in the inquest into the death of Mark Duggan has delivered a verdict of lawful killing.
mark duggan

The jury of three men and seven women delivered its verdict - by a majority of 8 to 2 - to the Coroner at the Royal Courts of Justice after seven days of deliberations.
The 29-year-old was shot dead by firearms officers in Tottenham in August 2011. His death sparked the London riots.
Police believed he planned to pick up a gun from another man, Kevin Hutchinson-Foster, and then move on to Broadwater Farm and had been following him.
At the centre of the inquest was the issue of the handgun that Mark Duggan was believed to have with him.
The Independent Police Complaints Commission had to apologise in the days after his death for leading journalists to believe he had fired at police when the shooting happened.
A gun was found 10 to 20 feet from Mr Duggan's body on the other side of park railings wrapped in a sock.
The police marksman who shot Mark Duggan claimed during the Inquest that he acted in self-defence because he thought Mr Duggan was brandishing a firearm.
The Inquest jury found that Mark Duggan was carrying a gun in the mini cab he was travelling in when he was killed but it was more likely than not that he had thrown it over a fence as soon as the car was stopped, meaning he not have it in his hand.

They said that police had not done enough to gather and react to intelligence about the possibility of Mr Duggan collecting a gun from Hutchinson-Foster.
But they found that the car had been stopped in a location and in a way that "minimised to the greatest extent possible recourse to lethal force".
There were dramatic scenes in court when the conclusion was given, with Mr Duggan's brother swearing at the jurors as they left court. Other supporters shouted "murderers". Some smashed a door and security staff were called to contain the situation.
The Independent Police Complaints Commission is still investigating the incident.
In an interim statement in August, it said it had so far found no evidence of criminality by police officers.
